Kamanga contempt halted

By CHARLES MUSONDA
THE Ndola High Court has stayed contempt proceedings against Football Association of Zambia (FAZ) president Andrew Kamanga and seven others in the Lusaka Magistrates’ Court.
Lusaka Chief Resident Magistrate Lameck Mwale yesterday told Kamanga and his seven co-accused that there will be no further action in the Subordinate Court against them, pending further guidance by the Ndola High Court.
This was after defence lawyer Chifumu Banda told Magistrate Mwale that the defence team was in receipt of an order signed by Ndola High Court Judge Mary Mulanda staying contempt proceedings.
Banda then submitted the order to Mwale and sought the court’s guidance.
In turn, Mwale told the accused persons that in view of what Banda had submitted and in compliance with the High Court, there will be no further action against them in his court as contempt proceedings had been stayed.
“We shall await further guidance from the High Court,” Mwale said.
The case was yesterday scheduled for ruling on a preliminary issue the defence raised at the previous sitting that contempt proceedings against Kamanga and others should have been instituted in the Ndola High Court where the main matter started from and that Mwale has no jurisdiction to hear the case.
It was also scheduled for possible plea by the accused persons.
In this case, Damiano Academy Football Club secretary general Damiano Mutale and his Zanama Brave Rangers Football Club counterpart Patson Lusaka, through their lawyer Gilbert Phiri, filed a complaint of contempt of court against Kamanga, FAZ general secretary Adrian Kashala, FAZ electoral committee chairperson Ronald Hatoongo and his committee members Steve Nyondo, Alistair Kaleji, Bazolo Mseteka and Christopher Munachuka.
Mutale and Lusaka wanted the seven to be cited for contempt of court for proceeding to hold and conduct the FAZ electoral process and elections in breach of the court order dated March 11, 2020 which was granted by Judge Mulanda.
And according to Justice Mulanda’s order presented in court yesterday, the current contempt proceedings at the Lusaka Magistrates’ Court involving Kamanga and others have been stayed pending determination of a similar application filed in the Ndola High Court by the plaintiffs.
