GOVERNMENT PONDERS WAY FORWARD OVER CEC JUDGEMENT

By SILUMESI MALUMO

I WILL engage the Attorney General to see what next we can do as government on the judgement made by the High Court to quash my decision to declare Copperbelt Energy Corporation (CEC) transmission as common carrier, Energy Minister Mathew Nkhuwa has said.

Mr Nkhuwa said after consulting the Attorney General, Government would then decide whether it would be neccessary to appeal the judgement.

The minister said the government’s legal team would know the route which can be taken on the judgement.

“My Permanent Secretary has just sent me the judgement made by the High Court today (Saturday) and I am trying to go through it.

And the issue is that today (yesterday) is Saturday so we cannot do anything. So what we shall do is that come Monday we shall engage our legal team so that this matter can be addressed.

For now this is what i can say, more will be done on Monday,” Mr Nkhuwa said.

On Friday, Lusaka High Court Judge Elita Mwikisa quashed the Energy Minister’s decision to declare CEC’s transmission and distribution lines as a common carrier.

According to her findings, Judge Mwikisa said CEC was not fairly treated by the minister who arbitrarily used his powers to declare its transmission and distribution lines as common carrier without giving it a chance to negotiate terms and conditions for the use of its infrastructure.
