Honeybee insists licence must not be revoked

HONEYBEE Pharmacy Limited has requested the court not to dismiss its matter where it is seeking an order to prevent the revocation of its licence by Zambia Medicines Regulatory Authority (ZAMRA).

It said Zambians needed to know the truth about the debatable public issue.

 According to Honeybee, ZAMRA’s application asking the court to dismiss the case is a way of wanting to delay justice after realising that the action to revoke the pharmaceutical licence was injurious, malicious and unjustifiable.

Honeybee has asked the court to dismiss ZAMRA’S application.

Earlier, ZAMRA asked the court to dismiss the matter saying Honeybee has not shown reasonable cause of action and that the action is an abuse of the court process.

It contended that Honeybee has no locus standi in relation to the pharmaceutical licence as the same was not granted.

But in an affidavit, Honeybee managing director Zakir Hussein has argued that ZAMRA’s application does not disclose any purported deficiency in its originating process.

Mr Hussein stated that ZAMRA’s purported application should be expunged from the record.

He said the basis of suing ZAMRA is whether it can engage in acts disturbing the business of Honeybee when they were not a party to the contract between the pharmaceutical company and the procuring entity in the contract supplied.

Mr Hussein stated that cases should be heard and determined on their merits and not on technicalities and piecemeal.
