AKAFUMBA-LED NDC LAWYERS DEMAND K500, 000 COSTS FROM KAMBWILI

By GRACE CHAILE LESOETSA

NATIONAL DEMOCRATIC CONGRESS (NDC) lawyers Japhet Zulu Advocates are demanding K500,000 from Chishimba Kambwili as costs in the matter where his application challenging the decision of Ndola High Court judge Mary Mulanda to allow the party to commence contempt proceedings against him was dismissed.

Mr Kambwili,Saboi Imboela, Dr Paul Mbulo and Ackson Kaonga who cited NDC Secretary General Bridget Atanga contended that Ms Justice Mulanda erred in law and fact when she allowed the Akafumba faction to commence committal proceedings against them.

They also argued that the Judge erred in law and fact when she allowed Ms Atanga to commence comtempt of court proceedings against them without having paid costs in a discontinued matter against Kambwili in the Lusaka High Court.

However the Court of Appeals dismissed the matter because Mr Kambwili and the others did not seek leave of the court before filing the application and were condemned to pay costs.

Japhet Zulu Advocates gave Mr Kambwili up to end of business yesterday to pay the said costs.

“The court awarded us  costs to be agreed  or taxes in default of agreement. Our costs are certainly more but for the sake of commiseration only,we peg our costs at the sum of K500, 000,” read the letter.
