Stop harassing ECL, Lubinda pleads with Hichilema

PRESIDENT Hakainde Hichilema should immediately halt the continued harassment of former President Edgar Chagwa Lungu through the law enforcement agencies because the former Head of State is enjoying immunity from prosecution, the Patriotic Front has demanded.

Given Lubinda, the acting president of the PF has stated that the Drug Enforcement Commission (DEC), the Anti-Corruption Commission (ACC) had embarked on a systematic abuse and harassment of President Lungu through illegal activities such as searches and seizures.

In a letter to President Hichilema dated October 3, 2022, Mr Lubinda said it had become clear that the law enforcement agencies, the ACC and DEC had effectively unlawfully initiated criminal proceeedings against President Lungu when the former Head of State was enjoying immunity  from prosecution.

He said under Article 97 (4) of the Constitution, no criminal proceedings could be initiated against Mr Lungu as he was enjoying immunity from any proceedings.

Mr Lubinda said the ACC and DEC had been conducting arbitrary, unlawful, malicious and vindictive searches against Mr Lungu and has asked President Hichilema to immediately stop the harassment.

“We have noted with grave concern the continued and systematic abuse and harassment of former President, Edgar Chagwa Lungu through the illegal actions and activities of the law enforcement agencies particularly the DEC and ACC. “May we hasten to point it to you that as things stand, no criminal proceedings can be initiated against President Edgar Chagwa Lungu as he enjoys immunity from any such proceedings,” Mr Lubinda said.
