School leaver fined K12, 000 deflowering girl.

A GRADE 12 school leaver who denied deflowering and impregnating a Grade 11 girl has been ordered to pay K12, 000 by a Lusaka Local Court as compensation.

Senior Court Magistrates Pauline Newa and Miyanda Banda at Matero Local Court made the ruling in a case in which Eunice Hamilumbe, 61, of Chipata compound sued Rodgers Zulu, 19, of Chipata compound for allegedly deflowering and impregnating her daughter, Mary Kamisa, 18.

The court in ruling said that Mary was not mad to point at Zulu to be responsible of her pregnancy because there are many men in Chipata compound who are even working and that he failed to challenge her.

When the claim was read, Zulu denied responsibility, saying he never made love to Mary and that he just knows her from Chipata compound.

Hamilumbe told the court that when she saw Mary pregnant in December last year she revealed that Zulu was responsible.

In defence, Zulu who completed Grade 12 said he just knew Mary as a resident of Chipata compound.

He explained that he was surprised because he left Lusaka on October 29, 2017 for school on the Copperbelt only to hear in December that he had impregnated Mary.   She was at that time six months pregnant.

Mary testified that Zulu was her boyfriend since May last year and that she became pregnant in July. She said they made love on three occasions.

She testified that she even told Zulu when she concieved and was now eight months pregnant.

The court ordered Zulu to pay the fine with an initial payment of K1000 followed by monthly instalments of K300 and that he can go for DNA when the child reaches six months old.
