Man punches mother in-law to escape wife’s angry relatives

THERE was laughter in the Lusaka Local Court when a man said that he punched his mother in-law who was holding him to escape the wrath of his wife’s relatives who were beating him.

Ernest Kaunda, 46, of Garden House compound was testifying in a case in which his wife, Memory Kalengi, 42, of John Laing compound sued him for divorce on allegation that they have stayed on separation for four years.

The two got married in 1991 and have four children.

Kalengi told Senior Court Magistrate Abbyshine Michelo sitting with Magistrate Lewis Mumba at Kanyama Local Court that Kaunda left her on November 11, 2012 after he beat her.

She explained that on January 1, 2013 she texted Kaunda a message to apologise but he never replied.

Kalengi said when they sat with Kaunda’s relatives for about 15 times, he refused to change his stand.

In defence, Kaunda said that they were differing with Kalengi because she was making their daughters abort pregnancies without telling him.

He admitted punching Kalengi’s mother to escape when he came returned home drank because she was holding him as Kalengi’s relatives were beating him.

Kaunda said that he married another woman eight years ago and that he wanted to divorce Kalengi.

Magistrate Michelo noted that there were problems in the marriage because the two separated four years ago and that Kaunda married another woman.

He granted the couple divorce ordering Kaunda to compensate Kalengi K12, 000 with initial payment of K2, 000 followed by monthly instalments of K1, 000 and to be paying child maintenance fee of K600 per month. Property acquired together would be shared equally.

Pastor injures his wife’s genitals

A 37-YEAR-OLD housewife narrated before a Local Court in Lusaka that her pastor husband injured her genitals after he pushed in his fingers.

Dainess Katongo of Makeni Villa compound who the doctor put on bed rest, was testifying in a case in which her husband, Davis Mbasela, 55, sued her for divorce after he refused to reconcile with her.

However, Katongo who is pregnant, said that she still loved her husband.

The two got married in July 2016 and do not have children.

Mbasela told Senior Court Magistrate Abbyshine Michelo sitting with Magistrate Lewis Mumba at Kanyama Local Court that the four months he stayed with Katongo was hell because she refused to be controlled or apologise whenever she went wrong and that every time they differed, she attempted to commit suicide.

He explained that on one Saturday morning Katongo wanted to buy poison to commit suicide but fortunately a person in a drug store refused to sell it to her.

Mbasela further said that Katongo even packed her belongings but her mother told her not to leave.

Mbasela further said that Katongo put charms in her lotion and that on November 21, 2016 they were in the same court for reconciliation but he refused.

In defence, Katongo said that shortly after they married Mbasela started coming home late and that when she fell pregnant she became sexually hot but instead of him making love to her, he pushed his fingers in her private parts.

She explained that she was diagnosed and hospitalised because the doctor found her to have injured genitals.

Katongo further said that it seemed Mbasela wanted to bring back his former wife because while she was in hospital, she saw him with a card apologising to the woman.

“I cannot divorce Mbasela because of the situation I am in, he should give me sometime as I cannot do any work,” said Katongo.

But Mbasela said that he did not push his fingers in Katongo’s private part but that it was romance because people touch each other and that he wanted to give Katongo the card as a surprise but he burnt it.

Magistrate Michelo said that Mbasela and Katongo had been married for a short period, adding that the couple were in the same court for reconciliation but failed.

He granted the couple divorce without compensation but Mbasela was told to maintain Katongo with K800 for the period of six months since she was pregnant.

‘Who shaved my husband’s pubic hair?’

A 33-YEAR-OLD woman narrated before a Local Court in Lusaka that she was shocked after discovering that her husband’s pubic hair was shaved on his return from working.

Bibian Chanda of Garden House compound was testifying in a case in which her husband, Emmanuel Moyo, 38, a driver sued her for divorce.

However, Chanda said that she still loved her husband.

The two got married in 1999 and have four children.

Moyo told Senior Court Magistrate Abbyshine Michelo sitting with Magistrate Lewis Mumba at Kanyama Local Court that they had been having marital disputes with Chanda since they got married.

He explained that being a driver who moved a lot, he impregnated another woman in 2014. When he told Chanda, she got very upset and used different objects to beat him and chased him from the house.

Moyo said that Chanda started coming home around 22.00 hours and that sometimes she would spend nights out.

In defence, Chanda said that when Moyo went to the Copperbelt to work for six months she was shocked that his pubic hair was shaved when tradition demanded that they shaved each other.

She further explained that when she was doing laundry, she found condoms in Kaunda’s pockets which he said were for his friend.

Chanda said that Moyo was always running away from her to answer the phone until one day she got the number of a woman who insulted her but claimed she had a child with her husband.

She cried that day and Moyo told her that the woman was right to insult her, adding that her husband left the matrimonial home on his own.

But when the court asked Moyo if he wanted to divorce Chanda, he changed his mind and said that he wanted to reconcile with her because he was looking at the welfare of the children.

Magistrate Michelo said that it was better to reconcile than to divorce because Moyo was used to Chanda.

He advised, however, that Moyo as a man should not leave the house and that Chanda should not come at night, sleep out or chase Moyo. He reconciled the couple .

Man fined K500 for calling woman a witch

A 24-YEAR-OLD man who admitted calling a woman a witch because she allegedly said he will die was fined K500 by a Lusaka Local Court as compensation for defamation of character.

Jackson Mumba a barber of Kanyama compound was testifying in a case in which Sarah Mwando, 52, a vendor of New Kanyama compound sued him on allegation that he insulted her by calling her a witch.

Mwando told Senior Court Magistrate Abbyshine Michelo sitting with Magistrate Lewis Mumba at Kanyama Local Court that she knew Mumba because he was one of her mother’s tenants.

She explained that Mumba came at her makeshift shop at A1 milling and insulted her by referring to her private parts.

She said he then called her a witch because her private part was all covered with grey pubic hair.

“I shed my tears and my witness, Pascal Chishala, said that I should not touch him or do anything,” said Mwando.

Mwando’s witness, Chishala testified that Mumba came at Mwando’s makeshift shop drunk and insulted her by mentioning her private part and said she was a witch.

In defence, Mumba said that on November 15, he heard that there would be a pruning exercise at A1 Milling where he worked.

He explained that he heard Mwando that she had told his fellow workers that she had stripped him (Mumba) naked and that he did shave his pubic hair and that he would be pruned.

Mumba said Mwando went ahead to tell people that he (Mumba) would be pruned because she would even go on prayer and fasting so that he lost his job.

He said he stopped visiting her makeshift shop long time ago.

Mumba further said that fortunately his contract was renewed but Mwando did not like that.

“I went to drink beer and I came to her makeshift shop, I was asking my friend Keagan why she was going to his fellow workers instead of approaching me.

“When Mwando responded, I told her that if she wanted to see my pubic hair, I can show her. I told her that she is a witch because she said I will die and the following day I sent my friend Oliver to apologise on my behalf to her,” said Mumba.

Magistrate Michelo said that it appeared that Mwando and Mumba had differences before.

He said that Mumba had no courage to confront Mwando but he got it after he drank beer and that he spoke in the manner he did under the influence of alcohol but later apologised when he realised that he was wrong.

He ordered Mumba to compensate Mwando with K500 in two monthly instalments of K250.

Wife catches hubby pants down committing adultery

A HOUSEWIFE narrated before a Local Court in Lusaka that she tracked her husband after he claimed to be sleeping at work and found him making love with his friend’s wife in the matrimonial house (friend’s).

This is in a case in which Joyce Lishala, 45, a Security Guard of Kanyama compound sued her husband, Maxwell Zulu, 51, also a Security Guard of Misisi compound for divorce.

The two got married in 2009 and have no children.

Lishala told Senior Court Magistrate Abbyshine Michelo sitting with Magistrate Lewis Mumba at Kanyama Local Court that problems started in 2012 when Zulu developed a habit of spending nights out and that in 2014, he went for a month and claimed that he was sleeping at work.

She then decided to follow Zulu and saw him enter a house of his friend, Banda, in Misisi compound and that when she entered after sometime she caught him red handed making love with his friend’s wife.

Lishala further told the court that in 2015, Zulu left her for three months and went to live with another woman again.

She further said that at one time she found Zulu drinking beer at 21.00 hours and that after she followed him she caught him again making love with another woman from the unfinished building.

“On December 3, 2016 after I slept at my relative in Kanyama where I went to see a patient, Zulu chased me and told me to go and drink ARVs, saying he has infected me with HIV virus,”  said Lishala.

In defence, Zulu said that he had been working at night since May 2016 and that he was hearing people saying that there was a man by the name of Simbeya, a wheelbarrow pusher who came to sleep with Lishala after drinking beer together.

He explained that since May 2016, Lishala had been sleeping in shorts.

Zulu further told the court that on December 3, Lishala did not sleep home thinking he went for work and that was how he chased her after she became rude.

Zulu further said that he was sure that Lishala was flirting with Simbeya because on one occasion, he found them in a tavern seated together.

Magistrate Michelo said that there was a problem because Lishala and Zulu suspected each other of having extra marital affairs.

He said that it was clear that the two could not live together and that since both of them wanted divorce, he would grant them their wish.

He granted the couple divorce without compensation but that property acquired together would be shared equally.
