A 24-YEAR-OLD man has been sentenced to nine months imprisonment for Theft Contrary to section 272 of the Penal code chapter 87 of the laws of Zambia.
This is in a matter where Maxfold Hamoonga of House Number PMS 94 Macha Road compound was accused of stealing iron sheets.
Brief facts before court are that on October 30, 2021, Oliver Muchimba reported that he had secured his premises in Macha road before leaving but discovered the following morning that 5 by 5 meters of iron sheets valued at K1, 950 were missing.
He then queried the security guard who told him that Maxfold Hamoonga took the items because he had claimed they were his.
Police interviewed the accused who did not deny committing the offence while property worth K350 was recovered.
In his mitigation, Hamoonga asked for lenience saying he had learnt how problematic the environment in custody was.
Having considered the mitigation and that he is a first offender, magistrate Muyambango Munukayumbwa exercised maximum lenience and sentenced the accused to nine months imprisonment.
