Mundubile, Makebi secretly taken to Solwez

i By NATION REPORTER THE State yesterday secretly moved Brian Mundubile and his running mate Makebi Zulu from Kabwe to Solwezi, where they are expected to appear in court today on sedition charges without notifying their lawyers, sources close to the matter have disclosed. Mr Mundubile, Mr Zulu together with 16 others, are facing various offences, including treason, in connection with allegations arising from events after the August 13 general elections. They have been in detention without appearing in court for over a month at Mukobeko Maximum Correctional Facility Highly placed sources said it was unclear why the sedition matter had been taken to Solwezi when neither of the accused lived there and the alleged offence was said to have been committed in Lusaka. “They are being taken to Solwezi where they will appear tomorrow (today) on the sedition charges. None of them live in Solwezi. The offence that the State is alleging happened in Lusaka,” the source said. “There is no explanation as to why the matter is being taken to Solwezi, and no explanation at all is being given by the State. The lawyers representing Mr Mundubile and Mr Zulu have not been informed about this development and it would appear that they want to deny the two leaders their right to legal representation,” the source said. The source explained that it was also unclear whether the accused would remain incarcerated in Solwezi or be returned to Kabwe where they been at Mukobeko. The source stated that the arrangement would be logistically difficult for the accused. The source said moving accused persons secretly without informing their lawyers could interfere with their constitutional right to legal representation. “If you are secretly moving people from one town to another town for them to appear in court, that goes against the constitutional guarantee that you have the right to have counsel,” the source said.
