A 14-YEAR-OLD described her boyfriend accused of having defiled her as a loving and caring person who showered her with gifts.
This is in a case in which Edwell Muchimba, 22, is appearing in the Choma Fast Track Court for Gender-Based Violence charged with defilement contrary to the Laws of Zambia.
Allegations are that Muchimba on July 10 in Choma unlawfully had carnal knowledge of a girl below the age of 16.
When the matter came up for trial before Resident Magistrate Ethel Phiri, the girl testified that her boyfriend took her to his relative’s place where they had sex on two occasions after promising her marriage.
She said they were in a relationship and she did not disclose her age to Muchimba who constantly showered her with gifts.
In cross examination by a lawyer from the Legal Aid Board, Ernest Chilufya, the victim said she did not know her real age though she insisted that she was told that she was 14 years old.
Further cross examination by another lawyer Melissa Mulubwa, the girl said she couldn’t remember the year, month or date when she was told that she was 14 years old.
She denied assertions from the defence that her parents wanted to marry her off to an older man because Muchimba doesn’t have money.
The matter was adjourned to December 14 for continued trial after Public Prosecutor Catherine Sakala applied for an adjournment.
