THE Law Association of Zambia (LAZ) has been joined as an interested party to a matter where lawyer John Sangwa wants the Judiciary to formulate its own regulations prescribing the prerequisite and other conditions of service of Judges.
LAZ had applied to be joined to the matter on the basis that Mr Sangwa’s petition where he cited the Attorney General Likando Kalaluka as the respondent raises pertinent constitutional issues.
“By consent of the parties, it is hereby ordered and directed that the intended interested party be joined to this cause as an interested party. That the originating process be amended accordingly to indicate the intended interested party as interested party in this cause and that costs occasioned by this application be in the cause,” Justice Martain Musaluke ordered.
Mr Sangwa petitioned the Constitutional Court seeking a declaration that the President should not prescribe the emolument of the Judges.
He seeks an order of mandamus directed to and compel the Minister of Finance to put in place, within three months or such period as the court may deem appropriate from the date of the order, measures satisfactory to the Judiciary.
He stated that this will ensure that the Judiciary is financially independent and becomes a self-accounting institution in line with Article 123 (1) of the Constitution and is adequately funded in every financial year in line with Article 123 (2) of the Constitution.
