STATE APPEALS KAMBWILI’S ACQUITTAL

THE State has appealed against the acquittal of Chishimba Kambwili in a matter where he was charged of being in possession of property and money suspected to be proceeds of crime.
Mr Kambwili, who was arrested in 2018 was on September 9 this year acquitted of 39 counts of obtaining property and money deemed to be from proceeds of crime and uttering false documents in relation to his company Mwamona Engineering and Technical Services Limited.
High Court Judge Mwaka Mikalile, sitting as a maigistrate, set Mr Kambwili at liberty on account that the prosecution had failed to prove the case beyond reasonable doubt.
In its appeal, the Director of Public Prosecutions has raised four grounds of appeal.
The State stated that Ms Justice Mikalile erred in law when she held that the grounds for suspecting that the money to be proceeds of crime in possession of Mr Kambwili had been watered down.
