Chinsali MP appeals seat nullification

PATRIOTIC Front’s Kalalwe Mukosa has appealed the High Court’s decision to nullify his election as Chinsali Member of Parliament contending that there was no evidence to prove that he committed the alleged electoral malpractices.
Lusaka High Court Judge, Timonthy Katanekwa in his judgement said the allegations of electoral malpractice, vote buying, intimidation and violence had been proven beyond reasonable doubt to have affected the August 12 general election in Chinsali.
Losing UPND candidate Charles Musanya and independent Christopher Chiponde had petitioned the election.
But Mr Mukosa in his appeal filed in the Constitutional Court states that the Judge erred in both law and fact when he held that the allegations of electoral malpractice, vote buying, intimidation and violence had been proven beyond a reasonable doubt in the absence of evidence supporting the said allegations.
He stated that the lower court was incorrect to state that the people of Chinsali were prevented from voting for their preferred candidate.
