Kambwili put on defence in ECL libel

NATIONAL Democratic Congress (NDC) leader Chishimba Kambwili has been found with a case to answer in another defamation of the President case.

This is in a matter Kambwili has been charged for allegedly referring to President Lungu as a dog from Chawama compound.

High Court Judge Lameck Mwale, sitting as Lusaka Chief Resident Magistrate, yesterday found Kambwili with a case to answer after finding that the prosecution has established a prima facie against Kambwili warranting to put him on his defence.

The NDC leader will open his defence on April 20, 2021.

Last November, Kambwili was put on his defence by Lusaka Magistrate Felix Kaoma in the other  defamation of the President case in which he is charged for alleging that Lusaka business executive Valden Findlay was using the Presidential jet to courier drugs.

This matter comes up on April 16, 2021 for continued defence after it was abruptly adjourned last month when the former Roan MP fell ill as a result of high blood pressure and diabetes just after he opened his defence.

He was found with a case to answer barely a month after High Court deputy registrar David Simusamba, sitting as Lusaka Principal Resident Magistrate, jailed him two years with hard labour for forgery and uttering a false document relating to registration of his Mwamona Engineering Technical Services (METS) at the Patents and Companies Registration Agency in 2001.

Last week High Court Judge Mwaka Mikalile, sitting as Lusaka Principal Resident Magistrate, heard that METS used a fake Zambia Revenue Authority (ZRA) tax clearance certificate to get a construction contract worth K14 million from Zesco Limited and a subcontract worth about US$1.6 million from China Henan International Corporation on construction of the Mansa-Luwingu road and township roads in Mansa and Luwingu.

He is jointly charged with his son Mwamba and two ZRA officers Mulenga Kapilima and Brano Lukwesa Musonda for making the fake tax clearance certificate, uttering a false document, obtaining pecuniary advantage, and 37 counts of possessing K6 million reasonably believed or suspected to be proceeds of crime.

Trial continues tomorrow.
