CLIENT ASSAULT

A FINANCIAL lending Director of Choma has appeared for defense in the Choma magistrate court in which he has been dragged to court with the security guard by his client.

This is in a case where Ginwell Yooma and another, are charged with assault occasioning actual bodily harm contrary to section 248 of the penal code Chapter 87 of the Laws of Zambia.

Particulars of the offence are that Ginwell Yooma and George Makuni on October 20, 2021 at Choma District jointly and whilst acting together did assault one Choolwe Mazunda thereby occasioning her actual bodily harm.

In his defense, 37 year old Yooma of Harmony settlement in Choma told the court that he was informed of the complainant’s refusal to leave the office of CBO Savings and Credit  Copperative office at around 20 hours on 20 October 2021.

  Yooma then said he went to meet the complainant and negotiated on how she was going to be paid but insisted that she was not going to leave until he and George Makuni, a security guard held her to make her leave.

He then narrated that he gave the complainant K50 for transport after she had asked him how she was to get home as it had been late.

“Your honor, I then drove off and left the place and was shocked to   be summoned for assault when I never beat the woman,”   Yooma said.

“I further think there is so much malice from the complainant as she did not want to leave our office from 9:00 hours to 20:00 hours despite explaining and even signing on the mode of payment to be used for her to get the money because we were unable to pay her that day,” said Yooma.

And George Makuni the co accused in the matter told the court that he did not assault the complainant but simply held her to make her leave the office as she was refusing to go 

He said after Yooma had left, he decided to report to Choma Police as the complainant kept following him every where and did not want to leave.

Through Counsel representative Enerst Chilufya of Legal Aid Board, the accused persons complained to court that the complainant was harassing one of the witnesses in the matter, Churchill Mweemba by threatening physical harm.

Senior Resident Magistrate Peter Mungala warned the complainant to desist from the alleged harassment and adjourned the mMatter to 2 December 2021 for continued defense while extending Police bond to the accused persons.
