MAN COMPLAINS OF POLICE BEATINGS

A 39 year old man of Namwala District has disclosed how a beating in police custody has left him bleeding in the ear and loss of hearing in some instances.

Appearing before Resident Magistrate Ethel Phiri on a charge of incest contrary to section 159 (1) of the penal code chapter 87 of the laws of Zambia as read together with act number 15 of 2005 and Act No of 2 of 2011 on Tuesday in the Chomamagistrate court,  the named man (name withheld) , told the court that he was beaten by police in June and has been experiencing   bleeding in the ear since then.

“ I went to the clinic after being beaten in June and was issued with a medical report which the police did not want to look at,” the man  said.

Particulars of the offence are that on an unknown date but between the month of October and March 2021 in Choma, the man unlawfully had carnal knowledge of a girl,  knowing her to be his daughter.

State prosecutor Dexter Kwalela informed the court that the state has not received instructions from the Director of  public prosecution on how to go about the matter and has since applied for an adjournment as they wait for instructions.

Magistrate Phiri has since adjourned the matter to 16 November 2021 for mention while the man remains remanded in police custody and has instructed the prosecutor to follow up on him getting medical attention.
