Man denies drug trafficking, accuses missing brother of offense

A 30-YEAR-OLD man has denied trafficking in marijuana and has instead accused his brother, who is on the run, of the offense.

Dominic Munachoonga,  of Simulangu village in Chief Macha area, has been charged with  trafficking in narcotic drugs, contrary to section 15 of the Narcotic Drugs and Psychotropic Substances Act.35 of the laws of Zambia, as read together with Statutory Instrument No. 119 of 1995.

Particulars of the offence are that Dominic Munachoonga, on 26 August 2021 at Choma District of Southern Province of Zambia, did traffic in narcotic drugs, namely marijuana weighing 50.6 grams without authority.

However, in his defense the accused denied the charge, saying it was his brother, Monday, who was trafficking in marijuana and that he was only picked by Drug Enforcement Commission officers because they did not find his brother.

He told the court that on 29 June 2021, DEC searched his house and did not find any drugs. Then on 26 August 2021, DEC went again around 02:00 hours and searched his house.

Mr Munachoonga said it was then that he was arrested but was only shown the marijuana purported to have been found on him, six days later as evidence.

And in cross examination by the state, the accused denied being owner of the drug and also denied demolishing the house where the marijuana was found saying he had been in custody since his arrest.

Senior Resident Magistrate Peter Mungala adjourned the Matter to   December 6, 2021, for continuation of defense.
