ATTORNEY General Mulilo Kabesha has filed a notice of motion to commence contempt proceedings against outspoken PF member of the Central Committee Raphael Nakacinda over his alleged contemptuous statement against the Judiciary.
The State which was on Thursday granted permission by the Lusaka High Court to commence the said proceedings, wants Mr Nakacinda to appear before the same court to show cause why he should not be sent to prison.
The notice of motion for an order of committal proceedings read: An order to commit the alleged contemnor (Nakacinda) to prison for deliberately and willfully bringing the Judiciary in disrepute for the false, malicious and contemptuous words uttered by him on December 13, 2021 and costs to be taxed on default of agreement.
In an affidavit in support of summons for leave to commence contempt proceedings, Mr Kabesha stated that Mr Nakacinda’s statement that President Hakainde Hichilema had been summoning Judges with the intention to influence the outcome of the court process are contemptuous.
He said the said words were understood by the public to mean that there is interference in the deliberations of the Judges handling the matter of Bowman Lusambo and other PF MPs vs the AG.
The eight PF MPs have however discontinued the said matter where they challenged the Speaker Nelly Mutti’s decision to bar them from taking part in any Parliamentary business on account that their seats were nullified by the High Court.
