Food Agents forged Ministry of Agriculture contract – ETG

FOOD Agents of Zambia limited is alleged to have Falsified the purported contract with the Ministry of Agriculture for the supply of fertiliser at a contract price of K16, 560, 000, court documents have revealed.

ETG Inputs Zambia in its defence and counterclaim filed in the Lusaka High Court, has denied acting as Food Agents of Zambia’s agent in the procurement of the fertiliser but instead supplied fertiliser to the plaintiff (Food Agents Zambia) as a buyer according to the contract.

It has also accused Food Agents of Zambia of having sold some of the fertiliser at Kasumbalesa border to third parties other than the ministry they claimed was the intended recipient.

This is in a matter where Food Agent Zambia has sued ETG Inputs Zambia Limited, the Ministry of Agriculture and the Attorney General in the High Court. 

The plaintiff wants the Ministry of Agriculture to pay K16, 560, 000 for the supplied fertiliser as well as damages for breach of contract.

ETG has however contended that on February 7, 2023, acting as a seller and Food Agents Zambia Limited acting as a buyer entered into a contract of sale no.ETG/FAZ/2022-23/08/UREA for the sale of 690 metric tonnes of Urea fertilizer at a total amount of K15, 525,000

It submitted that it was induced by the plaintiff by way of misrepresentation to enter into a contract to supply them the fertiliser in order to honour the purported contract terms they executed with the Ministry when no such contract existed.

The company denied looting Food Agents Zambia Limited’s warehouses as alleged by the former.
