FORMER POST Newspaper proprietor, Fred M’membe has pleaded not guilty to several charges slapped on him, among them impersonation and disobeying court orders before Lusaka Magistrate Ireen Wishimanga.
Among the charges slapped on him, M’membe was charged with one count of personation of an officer of the Post Newspapers Limited in (liquidation) and personation of person appointed by the High Court as provisional liquidator.
Particulars of the offence where that, on dates unknown but between 1st November and 13th February, 2017 in Lusaka, jointly and whilst acting together with other persons unknown, did personate an officer of the Post Newspapers Limited in (liquidation) and personate a person appointed by the High Court as provisional liquidator.
In another count, M’membe was charged with disobedience of lawful orders. Particulars of the charge were that, on dates unknown but between 1st November and 13th February, 2017, in Lusaka district, M’membe, jointly and whilst acting together with other persons unknown, did disobey lawful orders by holding out as the person in control of the Post Newspapers Limited (in liquidation) when the company was in liquidation as per order of the High Court.
M’membe, in another count, was also charged with failure to deliver to the provisional liquidator the real and personal property, books and documents under his custody belonging to the Post Newspapers Limited (in liquidation).
In this charge, it is believed that M’membe failed to deliver to the provisional liquidator the real and personal property, books, documents under his custody being the properties, books and documents belonging to the Post Newspapers Limited (in liquidation).
The Magistrate court had slapped him with a charge of concealing or being privy to the concealing of the Post Newspapers Limited (in liquidation).
Mr M’membe was also charged with preventing the production of books or papers affecting or relating to the property or affairs of the Post Newspapers Limited (in liquidation).
And particulars of the charge were that Mr M’membe and other persons unknown, jointly and whilst acting together prevented the production of books or papers affection on relating to the property affairs of the Post Newspapers Limited (in liquidation) by continuously holding out to be in control of the Post Newspapers Limited and by appointing other officers purporting to be appointed by the Post Newspapers Limited (in liquidation) without the authority or consent of the provisional liquidator.
M’membe has pleaded not guilty to all the 5 counts and the matter has since been adjourned to 7th August, 2017.
