PROFESSIONAL Secretaries Association has been dragged to court for failing to pay almost K120,000 for supply of 845 T-shirts delivered in April, 2017.
This is contained in a statement of claim filed before the Lusaka High Court where MOBM Enterprises Limited has sued Professional Secretaries Association of Zambia (PSAZ) for K119,000 owed for the supply of 845 T-shirts to the institution earlier in the year.
According to MOBM Enterprises, PSAZ represented by their president Malaya Phiri, agreed to the supply of the T-shirts based on the terms and conditions set before the delivery of a local purchase order issued on supply.
“That on or about 18th April 2017, the defendants had requested the plaintiff to supply 845 T-shirts at a total price of K169,000 through a local purchase order number 051.
“That the defendants agreed with the plaintiff to supply the T-shirts based on defendants terms and conditions which were set forth in the delivery note and that the payment should be done within 7-10 days,” they submitted.
MOBM Enterprises have requested the court to order for the immediate settlement of K119,000 following an initial down payment the institution had paid towards the purchase of the 845 T-shirts.
They have complained that despite several reminders to PSAZ and its president, they have refused to settle the debt to date.
They alleged that both PSAZ and its president Ms Phiri have refused to acknowledge receipt of an extra order of 111 branded T-shirts delivered in April, 2017 which amounts to breach of terms and conditions of the contract leading to loss and damage for the plaintiff.
The company has since requested additional fees for breach of contract at K60,000 and loss of business in the value of K61,900 including other additional fees deemed fit for the plaintiff.
