A MAN has denied spending nights at a girlfriend’s house but said he was at his sister’s house to avoid his wife who insults him from ‘18 hours up to 06hrs’.

Kelvin Mutale, 38, of Chipata Overspill compound was testifying in a case in which his wife Ruth Mwila, 22, sued him for divorce.

The two got married in 2008 and  have five children though dowry has never been paid.

Mwila told Senior Court Magistrates Miyanda Banda, Pauline Newa and Ronnie Shafwensha at Matero Local Court that when Mutale started having money he started flirting with other women and even spending nights with a woman he has known for seven years now.

“There is no support, children are spending nights on empty stomachs but Mutale goes to eat at the same woman’s house,’’ said Mwila.

But in his defence, Mutale said the problem was that since Mwila heard that he had a girlfriend, she had begun to insult him.

He explained that Mwila would go to the same woman’s house and destroy items suspecting that he was there.

“Mwila insults me from 18 hours up to 06 hours and she reported me to police on several occasions. When I hear noise I would go to spend a night at my sisters place,’’ said Mutale.

Mutale stated that he buys food home and pays school fees for children and denied having a girlfriend insisting he didn’t even know the woman claimed to be his lover.

In submission, Mwila said that she wants Mutale to change saying he has a girlfriend and that he comes home bathed, adding that he doesn’t eat food home.

Mutale said he wanted Mwila to change also because she insults him a lot and that she throws his belongings outside when they differ.

Passing judgment, the court dismissed the claim because dowry was not paid saying there was no marriage but cohabitation.
