Mary Chirwa’s porno case commences, adjourned to  October 25, 2022

THE Mary Chirwa pornographic case came up in Court yesterday but has been moved to October 25.

This a matter in which an Economic Front Party member has sought judicial review to compel ZICTA  and the Police to release the findings of their investigations over the pornographic video allegedly involving Drug Enforcement Commission (DEC) director general Mary Chirwa, finally took off yesterday. But the State has applied for leave to set aside the application because the matter was brought to court out of time as it should have been before the court within 60 days.

The matter has since been adjourned to  October 25 at 14:30 hours to allow the applicants to respond against the application by the State.

The matter was before High Court Judge-in Charge Gertrude Chawatama.

In this matter, Mr Mwelwa Samuel Chilufya of the Economic Front Party is seeking an order of mandamus in the High Court demanding that ZICTA Director General and Zambia Police Inspector General release the findings of the investigation into the pornographic video.

Mr Chilufya submitted that on July 26, 2022, Whatsapp groups and several social media platforms were awash with pornographic videos showing a woman who was fondling her private parts and exposing her nudity.

He has told the court that on July 27, 2022, the Police Service through its spokesperson Ray Hamoonga issued a statement over the video in which he informed the nation that the police were investigating the matter to ascertain the people behind the production and circulation of the video.

Mr Chilufya has submitted that according to the Cyber Security and Cyber Crimes Act of 2021, the circulation of the said video was a criminal offence and that those who were involved should be found and dealt with by the law.

Mr Chilufya stated that while the respondents had failed to institute or conclude the investigations against the production and circulating of the video, they had moved so swiftly to investigate and arrest three women in Kitwe’s Mindolo Township for similar offence which the three had committed the same day.

 He said the Police IG and ZICTA DG needed to tell the public the truth about how far they had gone with investigations and whether they had ascertained that it was Ms Chirwa in the video that went viral in July.
