52-year-old man jailed for defiling grand daughter

A 52-year-old peasant farmer of Chipata district in Eastern Province has been jailed for 25 years with hard labour for defiling his 15-year-old granddaughter.

Appearing before High Court Judge Petronella Ngulube was Alick Banda-Nkhata of Vwala Village in Chief Chikuwe’s area who was convicted on one count of defilement contrary to the Laws of Zambia. Particulars of the offence were that on April 18, 2016, the convict had unlawful carnal knowledge of a girl who is lame. The court heard that the convict undressed the girl who had put on a pair of trousers and began defiling her.

When the mother heard that the girl had been defiled around 19 hours on the same day, she took her to Chiparamba Clinic where a nurse examined her and later referred her to Chipata Central Hospital.

In mitigation, Banda-Nkhata pleaded with the court to exercise maximum leniency on him as he was a first offender and did not waste court’s time by pleading guilty to the charge of defilement. And Ms Justice Ngulube said she took note what was in the mitigation and sentenced Banda-Nkhata to 25 years imprisonment with hard labour.
