THE Anti-Corruption Commission has arrested Mongu Subordinate Court Magistrate Webster Milumbe for conspiracy to commit a felony. ACC corporate affairs officer Christopher Chibanku said Milumbe, 42, of house no. 6, Kambule Street, in Mongu, has been charged with one count of conspiracy to commit a felony contrary to Section 394 of the Penal Code.

Particulars of the offence are that Mr Milumbe between May 1, 2014, and December 31, 2014, in Mongu district did conspire with Brian Mutoiwa, a court interpreter at the same court, to commit forgery by acknowledging that he had signed a warrant of commitment to undergo imprisonment for a named convict, thereby misleading the Zambia Correctional Services officers to release the convict prematurely. Mr Chibanku said the magistrate has been released on bond and will appear in court soon.

This comes barely a week after Mutoiwa was arrested on two counts of forging a judicial document and uttering false documents.  It is alleged that Mutoiwa, 38 of North Park area in Mongu, on May 1, 2014, and May 31, 2014, in Mongu district did forge a warrant of commitment to undergo imprisonment for a named convict by purporting that the document had been signed by Magistrate Milumbe when in fact not.  In the second count, the court interpreter on May 1, 2014, and December 31, 2014, is alleged to have knowingly and fraudulently uttered the false document to Nawa Nalumango, a prison officer at Mongu Central Prison. Mutoiwa has since appeared in court.
