THE Kitwe High Court has granted Copperbelt Minerals Processing Company (CMPC) Limited, notoriously known as Jerabos, an interlocutory order of injunction allowing them access to the Black Mountain.
The order, dated June 15, 2017 and signed by Judge Isaac Kamwendo, also prevents Nkana Alloy and Smelting
Company Limited and Chinese owned Tianjin Maolin Technology Limited from interfering with CMPC’s interest in the slag dump.
“The second and fourth defendants (Nkana Alloy and Smelting Company Limited and Tianjin Maolin Technology Limited) are hereby restrained by themselves, their servants or agents or whosoever is claiming authority under them, from interfering with the plaintiff (CMPC)’s quiet enjoyment of the Black Mountain pending the final determination of the matter by the Honourable Court or until such further order of the court,” Justice Kamwendo said.
This is in a case in which CMPC has sued ZCCM-IH, Nkana Alloy and Smelting Company, Chambeshi Metals Plc, and Tianjin Maolin Technology Company Limited over ownership of the Black Mountain.
The Jerabos are claiming an order that ZCCM-IH’s purported transfer of its shares in Nkana Alloy and Smelting Company Limited to Chambeshi Metals Plc and Tianjin Maolin Technology Company Limited, and all other subsequent transactions over the Black Mountain were null and void from the very beginning.
