Nevers ‘illegally’ sold HH’s land to Meanwood – court papers

MMD faction leader Dr Nevers Mumba and two others have been sued for allegedly selling land belonging to UPND president Hakainde Hichilema and another person.

In a statement of claim filed in the Lusaka High Court, Meanwood Property Developments Corporation have sued Dr Mumba in his capacity as Victory Ministries International president together with his trustees Mr Cosmas Mwananshiku and Ms Charity Daka.

The corporation indicated that it bought Plot No. 3672 situated in Kitwe from Dr Mumba and two others.

“The defendants as purported registered trustees of Victory Ministries International, executed the requisite documents to facilitate the conveyance of the land in question.

“We paid K1, 200, 000, 000 in full and as final payment for the piece of land and it was term of contract to deliver the land free of any inconveniencies whatsoever except for the workers who occupied some of the houses for a period of two months from the date of sale,” read part of the claim.

The corporation claimed that the said land was later established to belong to Mr Hichilema and Mr Mubambe Muchende who claimed to have joint ownership of a portion of the farm.

The corporation alleged that upon taking possession of the said piece of land and in an attempt to develop it, a band of people appeared and started cutting down trees and erecting a wall fence saying they were sent by Mr Hichilema and Mr Muchende.

Further that Mr Hichilema and Mr Muchende have maintained their joint claim that they own part of the land and have a certificate of title.

Meanwood claims that Dr Mumba and others ought to have known that they were selling land that was encumbered and that almost half of it belonged to Mr Hichilema and Mr Muchende. The company now wants the court to order Dr Mumba and others to deliver the said piece of land free of inconveniencies, damages for loss of business, cost and any other relief that the court may deem fit.
