Teacher drags land lady to court over eviction from the house

A 28-year-old man of Lusaka has sued his landlady in a Local Court for evicting him from the house without a notice.

This is in a case in which Obvious Kapata a Teacher of Kanyama compound sued his Landlady, Agnes Chansa, 36, of the same compound.

Kapata told Senior Court Magistrates Abbyshine Michelo and Esther Mulomba at Kanyama Local Court that on February 6, 2018 Chansa came to his house with five boys asking him to vacate the house because he did not pay house rentals of K450 on the due date February 5.

He explained that he had no arrears for the house and asked her if he could be given two days but Chansa wanted him to give her the money or vacate the house.

‘’I was afraid of the five boys who came with Chansa and I asked for 10 minutes to find where I can put my households but instead I went to Victim Support unit where they advised me to come to court,’’ said Kapata.

Kapata said that he was forced to move out of the house because Chansa came with her household to occupy the house after they went to police.

In defence, Chansa said that she got a loan from the bank and that she was paying K1000 per month adding that she was scared the bank could possess the house if she doesn’t pay back.

She explained that she told Kapata on January 20 to vacate the house on February 6 because he was not giving him full money and was taking time to pay.

Chansa added that she did not write a notice because she doesn’t know how to write.

In submission, Kapata said that he wanted Chansa to compensate him because he lost a memory card and a phone which he suspect five boys could have gotten them.

The court said that Chansa told the court that she told Kapata on January 20 to vacate the house.

The court said that Kapata removed households on his own and that he could have come to court before moving out of the house.

The court dismissed the case and told Kapata to report to police if he lost items.
