Two ndola churches clash over plot

TWO Ndola-based Pentecostal Churches have clashed over land to which they are claiming legal ownership despite the Ndola High Court having made a ruling.

This is in a matter in which the Chifubu Central Christian Brethren Church (CMML) and the Open Christian Brethren Churches-Chifubu Central Church (CBC) are fighting for the same plot, which is stand number CH/1079 in Chifubu.

According to the default judgment delivered in which the CMML sued leading elder of the splinter church, Open Christian Churches, the court ordered that the defendant in the matter surrenders the certificate of title relating to the plot in question.

“It is hereby ordered and adjudged that judgment in default be entered against the defendant (Kawambwa) as follows: a declaration that he is the legal and beneficial owner of plot # 1079 Chifubu Ndola; an order that the defendant (Kawambwa) surrenders the certificate of title relating to plot number 1079; an order of injunction restraining Kawambwa, his agents, servants or whomsoever from interfering with CMML quiet enjoyment of plot number 1079,” the judgment read in part. This follows the split of the CMML which later resulted in the aggrieved camp registering a new church which they called (CBC) and claimed ownership of the land on which the church is sitting on.

The CMML is claiming that the Open Christian Brethren Churches was a breakaway from CMML and wants to be worshiping in the same Church. According to the certificates of registration of the churches, CMML was registered on November 5, 2009, while the Open Christian Brethren Churches was registered on August 4, 2015.
