A non-commissioned officer has applied for judicial review challenging the State’s decision to discharge him from employment in the Zambia Air Force (ZAF) on grounds that he was not medically fit.
Christopher Kaboshe said that he has been examined by different qualified medical personal and has been certified him fit.
Kaboshe has cited the Attorney General as the respondent in the matter. In a statement for judicial review filed in the Lusaka High Court, Kaboshe stated that he was a senior aircraft man in ZAF.
He stated that on October 30,2004, he was given a discharge slip by the State.
Kaboshe stated that the State through its administration officer misrepresented the law as couched under Section 10 (A) (1) of the Defence Act.
He insisted that the Defence Act does not give powers to the administration officer or Lieutenant Colonel including the Air Force commander to dismiss any officer neither does it say that it can be done verbal from the Head of State but his own handwriting which was not the case.
“Your honour , I have been dragged from one hospital to another and by so doing , I have suffered mental torture, trauma and disturbance as all the undergone hospitals did not find the findings of why I was terminated or discharged from my duties,” Kaboshe submitted.
