Gen Chimese sued over property

RETIRED Zambia Air Force (ZAF) Commander Eric Chimese has been sued by a Lusaka resident alleging that he has refused to change ownership of a property despite payment of an agreed sum of US$65, 000.

Mr Charle Chigwedere wants the Lusaka High Court to compel Lieutenant-General Chimese to complete the change of ownership  into his name by way of signing the deed of assignment relating to stand no. LN -385/12, Lusaka.

In the alternative, Mr Chigwedere wants an order of the High Court Registrar to facilitate the signing of the deed of assignment.

He wants damages for the inconvenience caused by Lt-Gen Chimese’s failure to execute the assignments.

Mr Chigwedere in a statement of claim stated that Lt-Gen Chimese was at all material times the vendor of the property.

In October 2019, the two entered into a contract for the sale of the property and fixed the price of the property at US$65, 000.

On October 17, 2019, Mr Chigwedere claimed that he met the contractual obligations by paying Lt-Gen Chimese the full purchase price and the defendant acknowledged receipt of the said sum. 

“The plaintiff has made several attempts and efforts requesting the defendant to complete the change of ownership process but the defendant has refused, rejected and or/ neglected to sign the said deed of assignment relating to the conveyance of the property known as stand no. LN385/12, Lusaka,” he stated.

Mr Chigwedere alleged that he has suffered loss and damage.
