EXAMINE the matter involving the pardoning of Chishimba Kambwili so that it does not create inconsistency in the law and set a bad precedent because his appeal case for forgery is still active in court, the UPND Alliance has urged the Law Association of Zambia (LAZ).
Former President, Edgar Lungu, last month pardoned Mr Kambwili who was jailed for forgery but appealed the sentence.
Alliance spokesperson, Leslie Chikuse, said the pardoning of Mr. Kambwili would be a serious illegality if it was proved that his appeal case was still active in the court.
Mr. Chikuse said LAZ should probe the matter to prevent uncertainty in the law and avoid setting a bad precedent regarding the pardoning of a person whose case is still active in court.
“If the matter was still active and was still active in court, there is a lot of precedent to that effect, it’s important to declare the matter null and void unless there should be a very good explanation that comes from those that pardon,” he said.
Mr. Chikuse said if at any time the appeal was discontinued, the public would have known because the media followed Mr. Kambwili’s case with keen interest.
“The matter of Chishimba Kambwili was the matter that was being followed by the public because he is a public figure so if his appeal was discontinued we would have known about it because the media has done very well in reporting court cases of public figures,” he said.
