KCM lawyers withdraw from liquidation case

A prominent law firm has withdrawn from representing KCM (in liquidation) in a petition where ZCCM-IH wants the mine placed under liquidation.

In its notice, D.H. Kemp and Co stated that the firm’s decision to withdraw as co- advocates in the matter has been authorised by Konkola Copper Mine (KCM) provisional liquidator Milingo Lungu.

“Take notice that we, the undersigned  D.H. Kemp and Co, having been authorised by the provisional liquidator of KCM (in provisional liquidation), the respondent, to withdraw  from representing the said respondent, do  hereby cease to be one of the co-advocates acting for the said respondent in this matter,” it stated.

Other lawyers representing KCM are Messrs. Ellis and Company, Messrs. Andrew Musukwa and Company and Messrs. Makebi Zulu Advocates.

In this matter, ZCCM-IH has asked the court to place KCM under liquidation claiming that it was being managed in a manner that is detrimental to its interests.

Among other allegations are evading taxes and for being insolvent and that it has failed to pay outstanding invoices to suppliers and contractors.

Vedanta Resources Limited in its recent application asked the court to strike out or dismiss the petition arguing that the arbitral tribunal in South Africa is the only competent forum for dealing with any dispute within the parties.

It also contends that the petition should be dismissed for not disclosing any reasonable cause of Section 57 of the Corporate Insolvency Act and also have the provision of KCM liquidated discharges
