SANGWA TRASHES MUTTI’S RULING ON PF MPS


……Says speaker has over stepped her boundaries

Lawyer John Sangwa has described as wrong, unsound, undemocratic and illogical, speaker of the National Assembly Nelly Mutti’s ruling that members of Parliament whose elections were nullified in the High Court recently pending determination by the Con-Court should not sit and participate in parliament business.

Dr Sangwa said the constitutional interpretation of the speaker was unsound at law, and that it defied logic and common sense.

He said when he appeared on Diamond TV Live Programme last night that the ruling was undemocratic and at variance with the provision of Article 72 of the constitution and it’s values and principles.

He said that in his opinion, an appeal served as an automatic stay of execution which allowed affected members to remain members of Parliament pending determination of the Con-Court.

He said MPS had a choice to take the matter to court or accept the ruling of the speaker.
