CONSULTANT SUES ARC MINERALS FOR $50, 000

A ZAMBIAN mining consultant has sued Arc Minerals in the Lusaka High Court claiming $50, 000 as payment for consultancy services.
Mr Kamushe Kaemba said in June 2021, Arc Minerals which owns 66 percent shares in Zamsort hired him through its director Nick von Shirinding on a consultancy basis and the parties agreed on $50, 000 payment for the job.
Mr Kaemba stated that his main task was to assist the company to resolve problems that Zamsort was facing in establishing its mining interest in Mwinilunga under Senior Chief Sailunga.
He said in his statement of claim that in an oral agreement, he was required to help Arc Minerals with negotiations to end court cases that arose between the company and its former partners Zambia Mineral Exchange Limited which cases had affected the running of its mine.
He said this was to restore a sound relationship between Arc Minerals and the traditional leader regarding the social licence, as the chief wanted the mining company to leave the area.
Mr Kaemba was also required to facilitate the signing of a non-disclosure agreement.
He claimed to have executed all his tasks and the relationship between Arc Minerals and the chief as well as the community was restored with court cases dropped.
“Though Arc Minerals through von Shirinding, paid operational costs which were outside the contract sum of US$50, 000, the defendant refused to pay the plaintiff the aforesaid $50, 000 after the task was done by the plaintiff,” he said.
Mr Kaemba said his lawyers have sent several reminders to the defendant but has refused to pay.
He lamented that he had suffered loss, as he had spent many months in Mwinilunga holding meetings, travelling to and fro Lusaka, Mkushi, Kabwe, Ndola and Luanshya.
Mr Kaemba is also demanding interest on the said amount.
