Man in court for defiling an imbicile

TWO witnesses yesterday took the stand in the Lusaka Magistrates’ Court to testify against a 35-year-old man alleged to have defiled a 15-year-old imbicile of Mungule area.

When the matter came up for plea before magistrate Mwaka Mikalile, the accused, Saidi Zulu pleaded not guilty to the charge alleging that it was the girl’s stepfather who was having carnal knowledge of her.

It is alleged that Saidi Zulu defiled an embicile under the age of 16 years contrary to the laws of Zambia.

On September 5th 2017 in Lusaka, Saidi Zulu knowingly had unlawful carnal knowledge of a juvenile who to his knowledge is an imbicile.

The mother to the girl,  a businesswoman of Mungule area told the court that she had gone out for a meeting and left the victim and her young brother at home.

The mother testified that when she got back from the meeting, she heard her daughter coming from the neighbor’s house crying with bruises on her body.

The mother testified that her daughter told her that Zulu had come home and had carnal knowledge of her.

The victim’s mother narrated to court that when her daughter informed her of what transpired, she checked her private part and found some mucus-like discharge coming out.

“I checked my daughter after she told me of the incident and found mucus-like discharge coming out from her private part, and later went to confront Zulu who was taking some beer at the tavern next to my house,” she said.

Katiba said when she confronted Zulu, he denied having had carnal knowledge of her daughter. She told the court that her daughter said it was the third time such an incident happened with the accused.

And when the victim testified, she disputed the accused’s allegation that it was the stepfather who has carnal knowledge of her.

She testified that Zulu came home and grabbed her from the grass kitchen outside where she was cooking from and took her in the house where he had carnal knowledge of her.

She told the court that after he had had carnal knowledge of her, he sat in the sitting room and asked for water to drink.

She said it was the third time the accused had carnal knowledge of her and she could not scream because there was music playing at the nearby taverns.

The matter has since been adjourned to February 5th 2018 for continued trial.
