Court enters default judgement against Fimba Upoke

THE Lusaka High Court has entered a default judgement against Frank Zimba, creator of the “Fimba Upoke Dig” Facebook page, after he failed to file a defence in a defamation case brought by businessman Harry Findlay.
High Court Judge Gaudentia Salasini ruled in favour of Mr Findlay, granting final judgement in default of appearance and defence.
The court ordered Mr Zimba to issue a public media apology, retract his defamatory statements, and remove the offending publications from his social media platforms.
Judge Salasini also directed that Mr Zimba be restrained, whether personally or through his agents, from publishing or circulating any similar defamatory material against Mr Findlay.
The court also entered interlocutory judgement for damages for libel and slander, which will be assessed at a later stage, and awarded Mr Findlay interest and legal costs.
The case was from a video posted on July 28, 2025, in which Mr Zimba, through his “Fimba Upoke Dig” Facebook page, allegedly accused Mr Findlay of being involved in international drug trafficking together with the late former President Edgar Chagwa Lungu.
Mr Zimba alleged that Mr Findlay used diplomatic immunity and the presidential jet to transport drugs abroad and had influenced the Lungu family not to bury the former head of State in Zambia to hide the circumstances of his death.
