EX WORKER SUES FIRM FOR MALICIOUS ARREST

A FORMER employee of Nsimbi Steel Zambia, in Kafue, has sued the firm for allegedly accusing him of theft that led to his arrest and detention in police cells for three days.

Mr Elias Muyenga, in a statement of claim filed in the Lusaka High Court is demanding damages for false imprisonment and malicious falsehood.

According to his claim, Mr Muyenga said on 28th September 2016, he was detailed by his supervisor to deliver unsecured pipes to a customer in Lusaka using a Tata truck registration number ALC 7406 which he was not competent to operate.

While offloading the pipes, one of the pipe tilted forward and damaged the cabin of the truck.  He was subsequently suspended from work without being paid his salary for the month of September, 2016.

Mr Muyenga claimed that when he started demanding for his salary, the company,  through Mr Kennedy Daka did on 23rd October, 2016 go to his residence in Kafue where he was picked by a criminal investigations officer and arrested for three days and charged with an offence of breaking into a building.

“Nsimbi Steel Zambia, acting through its servant or agent, did on 23rd October, 2013, go to his residence in Kafue with a Mr Banda, the criminal investigations officer at Mumbwa Road police post arrested and subsequently detained me at Mumbwa police post for three days.

“Whilst at the police post, I was charged with an offence of breaking into a building and committing a felony therein which I was cleared by police on 17th February, 2017 due to lack of evidence,” Mr Muyenga indicated.

Mr Muyenga claimed that Mr Daka and the company had no justifiable reason to institute criminal proceedings against him as their report to the police was premised on malicious allegations against him, knowing well that the said report was untrue.

Subsequently, he claimed that the police report was made after he claimed his salary arrears from the company.

Mr Muyenga has also asked for damages, cost and any other relief that the court may deem fit.
