A MAN who was allegedly caught making love with a neighbour in the toilet told a Local Court in Lusaka that he warned his wife that she will hear that he made love with a neighbour because she denies him conjugal rights.
Oswald Mukando, 33, of Garden House compound was testifying in a case in which his wife, Rita Ntalasha, 25, a Security Officer sued him for divorce.
However, Mukando said that he still love his wife, Ntalasha.
The two got married in 2011 and they have one child. Dowry was paid.
Ntalasha told Senior Court Magistrate Mubukwanu Matakala sitting with Magistrate Abbyshine Michelo at Kanyama Local Court that Mukando has been accusing her of having boyfriends and that in 2012 and 2016 they went on separation.
She explained that last month when she came from Mumbwa she overheard the landlord complaining that Mukando will bring bad luck by making love in the toilet.
‘’When I confronted the neighbour who was making love with Mukando she admitted and asked for forgiveness. On April 16, 2017 Mukando said that his girlfriend is carrying his child and he even boasted that he can do whatever he wanted because his father married seven wives. I sued him for divorce because I don’t want to be in polygamy,’’ said Ntalasha.
In defence, Mukando said that problems started just after they married because there was a man who claimed that Ntalasha was carrying his child.
He explained that after Ntalasha started work in 2012, she would come home late and drunk, adding that she put a pin code on her phone.
Mukando added that he was living as if he was not married because it was his seven-year-old child who cooked for him and that he looked for people to do laundry.
Mukando further said that last year he took Ntalasha to her parents after she assaulted him and that when he followed her at her work place to reconcile, he was shocked to learn that she was in love with her workmate.
‘’We don’t make love for two months and when Ntalasha is off on Sunday, she gets children and goes to her parents. I told Ntalasha that she is troubling me by denying me conjugal rights. She will hear that I made love with a neighbour,’’ said Mukando.
Passing judgment, Magistrate Matakala said that there was no trust in their marriage because Ntalasha said that Mukando told her that his girlfriend was carrying his child and also Mukando suspects Ntalasha of having boyfriends.
He said that Ntalasha want divorce and that the court could not force her to continue in marriage.
He granted the couple divorce without compensation but Mukando is to be paying child maintenance fee of K400 per month. Households goods acquired together would be shared equally.
