A 46-YEAR-OLD woman has sued her husband in Lusaka Local Court for divorce alleging that he fails to perform in bed.

This is in a case in which Catherine Banda of Kabanana compound sued her husband, Kennedy Banda, 48, for divorce.

However, Banda said that he still loves his wife, Catherine.

The two got married in 1991 and have four children but dowry was not paid.

Catherine told Senior Court Magistrate Miyanda Banda sitting with Magistrate Pauline Newa at Matero Local Court that problems started in 2007 after Banda left home for nine months because when he came back he could not perform in bed.

She explained that after sometime when he was helped by traditional healers, he started performing but he later stopped again, saying for six months they have not made love.

‘’I tell him to stop touching me because he is not doing anything. I suspect he has another girlfriend who caused him not to perform in bed with me. I am tortured since the problem continues, that is why I want divorce,’’ said Catherine.

Catherine said that Banda was irresponsible because since they married he has not bought clothes for children.

In defence, Banda said that problems started when they had a third child because Catherine was told at hospital that if she would have another child, she would die because the uterus was weak.

He explained that later the uterus was cut and that each time he made love, he noticed blood on his manhood. As such, he stopped making love, saying she lied that he failed to perform.

However, Catherine refuted his claim, saying her uterus was not cut.

Magistrate Banda said that there was no marriage because dowry was not paid and he dismissed the case.
