Court awaits committal instructions in Levy Mkandawire killing

THE case of the man charged with killing UPND’s Kabwata Member of Parliament, Levy Mkandawire, in a road accident outside his house, has been adjourned awaiting committal instructions from the Director of Public Prosecutions.
The Lusaka Magistrate Court adjourned to a later date the matter of Jetta Alick Kalengo of plot number 32 Chalata Road, Woodlands Extension who was arrested and charged with causing death by dangerous driving, using a motor vehicle without a road licence, and without insurance.
Mr Mkandawire was hit and killed at the gate of his residence on November 18, 2021.
The matter came up yesterday before Lusaka magistrate Felix Kaoma but the accused was not present before the court.
The matter was called out by the state counsel and later adjourned to December 22, 2021 for mention and possible committal to the High Court.
It is alleged that on November 18, 2021 a (BMW) vehicle which was approaching from east towards west was moving at an excessive speed and in the process, the driver lost control of the vehicle before hitting into a stationary Toyota whose driver had disembarked with a view of opening the gate.
Due to the impact, it was forced to move forward thereby squeezing the victim (Mkandawire) against the wall fence and the wall pillar of the gate fell on him.
Police charged and arrested Kalengo aged 56 of and charged him with four offences after it was discovered that the accident was caused by him and not his wife Jane Mwale the woman who was accused of causing the accident.
Ms Mwale handed herself to the Police and after interrogations it was discovered that the husband was the one who was driving the BMW X5 registration number ALM 5955.
Police later disclosed that the accident was caused by Kalengo, and not Ms Mwale
Kalengo also confessed that he was the one who was driving the motor vehicle at the time of the accident.
Magistrate Kaoma set December 22, 2021 for mention and committal of the matter to the high court, he said the accused be remanded in custody until bail conditions are met.
