DIRECTOR of Public Prosecution (DPP) Lilian Siyunyi should simply resign and maintain her integrity rather than fight the charges raised against her by the Judicial Complaints Commission, Green Party president Peter Sinkamba has said.
Mr Sinkamba said it would be wise for Ms Siyunyi to just step down in order to safe guard her career which she has worked to build.
The embattled DPP lost her application at the JCC to be represented by the Attorney General.
Mr Sinkamba said that Ms Siyunyi, who was appearing before the JCC needed to do the right thing which was to step aside so that she may retain her State Counsel conferment and emoluments if she resigned.
He said it would be a different scenario if she was fired as she may lose both.
“The choice is hers. But like I said, legal gymnastics have short legs. Reality will soon catch up with her,” he said.
Mr Sinkamba said first, from its own procedural precedence, the Attorney General did not represent any judicial officer or judges that appear before JCC. Any appearance is either in person or lawyer of choice.
He said the Attorney General only attends as an interested party, and not to defend the accused judicial officer or judge.
He said the other factor was that the nature of cases that go to the JCC concern gross misconduct that was likely to bring the name and integrity of the judiciary into disrepute such as corruption, bribery, rape, defilement, etc.
“Thus, the State should not be seen to be shielding or entertaining gross misconduct and incompetence in the delivery of justice. The stream of justice must be pure, not polluted,” he said.
He said even if she appealed against this decision of JCC, she was likely to lose on this issue.
Mr Sinkamba said in fact, in all disciplinary cases involving Constitutional and public officers, the Attorney General did not represent them.
