Jimmy Bwembya told the Kitwe High Court that he signed the documents at gun point while being beaten.
In November last year, a trial within trial was ordered to allow for investigations of torture allegations against one of the suspects.
When the case came for continued trial, the defence had objected to continued trial arguing that their client was tortured in police cells.
In this matter, “Spax” aged 29, Boyd Kamizhi 24, Maclean Kamizhi 22, Gilbert Zimba 22, Syvio Kwibisa 22, and Jimmy Bwembya 23, are appearing before Judge, Abha Patel.
They are charged with three counts of attempted murder, rape and murder.
Particulars of the offence in count one are that between January 22 and 23, 2019, the accused murdered Mr Emmanuel Maponda of Chingola.
In count two, the accused persons between January 22 and 23 last year attempted to murder Mr Billy Maponda in Chingola.
In the third count the accused persons attempted to murder Ms Sheila Bwembya in Chingola.
In count four, between January 22 and 23, the accused attempted to murder Mr Stanley Maponda in Chingola.
And in the last count, they had sex with a woman without her consent.
Bwembya explained that he signed out of fear of being killed after the threats he got from the police.
Bwembya added that he later fell sick and could not be taken to medical personnel to receive treatment stating that the police could not allow him.
He said that he was three days later taken to Kamfinsa Correctional Service clinic where he was given pain killers and some ointment to apply on his wounds.
