PF Cadres remain in custody

THE trial of the two Kasama based PF cadres charged with malicious damage and unlawful wounding has failed to start in the Kasama Magistrates’ Court, due to non availability of the magistrate presiding over the cases.

The two accused persons namely Whiteson Mutantabowa 34 and Journey Yambayamba 32 have been jointly charged with the said charges for allegedly having damaged a Toyota Vista Registration Number ABT 375 valued at K40,000, the property of Jairo Simbeye and assaulting Mwila Kampamba on 16th September 2020, near Kasama-Shoprite.
The two accused persons who have legal representation from Northern Province Legal Aid office, were supposed to appear before Principal Resident Magistrate Oswald Chibalo.
When the matter came up National Prosecutions Authority or NPA Senior Public Prosecutor John Kamfwanka informed Magistrate Joe Samboko who represented his superior that trial would not start, as the trial magistrate was out of the district.
Mutantabowa and Yambayamba have since been remanded in custody at Kasama’s Milima Correctional Service and will appear before the court on October 15, 2020, for commencement of trial before Principal Resident Magistrate Oswald Chibalo who is also presiding over the UPND Deputy.
Principle Resident Magistrate Chibalo who is presiding over the matter has not granted the accused person bail because of their failure to avail the court with their fixed abode.
