A South African company, Tufbag (PTY) Limited, has applied for leave to commence proceedings in the Lusaka High Court against Konkola Copper Mines (KCM), a company in liquidation, and is demanding settlement of US$42,768 debt.Tufbag wants the court to order KCM to pay US$42,768 being the unpaid purchase price for the polypropylene woven bags supplied to the Mining firm and is also demanding interest on the said amount.According to a statement of claim filed in the Lusaka High Court, Tufbag, whose office is in Kwa Zulu Natal Province is in the business of manufacturing and selling bulk sacks, bags and other related products.The plaintiff stated that the company and KCM entered into an agreement to supply the Mine with a consignment of 10,800 polypropylene woven bulk bags worth the amount in question under commercial invoice no. 016566 on November 7, 2019.It stated that it was an express term of the agreement that for each delivery, payment would be due within 60 days.Tufbag stated that KCM has however failed or neglected to pay it for the said supply.
