SLAIN BUSINESSMAN, REEVES MALAMBO’S ESTATE SUED

A LUSAKA woman has sued the administrators of the estate of the late Reeves Malambo for allegedly possessing property obtained by fraudulent means.

She has also sued her ex-husband who sold the property to Mr Malambo.

In a statement of claims filed in the Lusaka High Court principal registry, Pearl Nyondo claimed that in 2000, she applied for a piece of land from the Commissioner of Lands and was granted the said piece of land. Ms Nyondo, asked the court to declare that she was the legitimate and legal owner of plot No. 11250/M. Ibex Hill, Lusaka.

She alleged that her ex-husband, stole the certificate of title deeds, which he pledged to Premier Finance Company Limited, for funds he borrowed, without her consent or authority.

She said that the said Premier Finance Company went on to put the property on mortgage which was later on withdrawn. Ms Nyondo submitted that her ex-husband then acquired a loan from Mr Reeves Malambo and that a third party mortgage was registered on her property.

She claimed that her ex-husband further acquired a loan of K32,000. 00 from Mr.  Malambo leading to a further charge on her property.

“Further on 4th July, 2008, my ex-husband borrowed K32,000.00 from Mr Malambo, leading to a further charge being created on my property.

“All this was done without my consent or knowledge,” she submitted.

Subsequently, on 29th October, Mr Malambo discharged the mortgage and further charge as created on the subject property.

She submitted that her ex-husband sold the said property to Mr Malambo at K246, 000.00 and that the certificate of title was issued in favour of Mr Malambo.

Ms Nyondo claimed that the title of certificate the late Mr Malambo obtained was a fraudulent one as she did not give consent, authority or power of attorney to pass on the subject property.

“All the transactions in the subject property were not done by myself nor my authorised agent and had no blessings from me. “My ex-husband had no good title nor power of attorney to pass on my property to Reeves Malambo and as such, the title issued to him is a fraudulent one as it was procured fraudulently and should be cancelled,” she said.

Ms Nyondo is claiming a court declaration that the purported sale of the property was fraudulent hence Mr Malambo could not have interest in it.

She also claims an order of cancellation of certificate of title issued in favour of Mr Malambo and an order for the subject property to be re-registered in her name.
