Preacher in dock over unpaid K80, 000

 A PASTOR has been dragged to the Lusaka High Court by a businessman for allegedly refusing to pay back K80, 000 he had borrowed.

According to a statement of claim filed in court, Joshua Simuchenje sued Pastor Peter Chanda whom he claimed neglected to settle monies owed as per agreement after several reminders to do so.

Mr Simuchenje alleged that on September 8th 2017, he entered into a contract with Pastor Chanda and that the clergyman borrowed K85, 000 at his own request which he agreed to pay back within one month from the date of borrowing.

He claimed that as security for the loan, Pastor Chanda surrendered the white book for his motor vehicle as guarantee.

“I shall state at trial that as security for the loan the defendant surrendered the white book for his motor vehicle Toyota Prado registration number ALB 4697 and that in default of payment the motor vehicle would be forfeited and considered to have been sold to me to recover the money,” read the claim.

Mr Simuchenje claimed that Pastor Chanda went on to issue post-dated cheques dated 17th, 18th, 19th and 20th December 2017 which to date had not been deposited due to insufficient funds in his account.

He claimed that Pastor Chanda had refused to settle the matter as per agreement or to surrender the said motor vehicle and had made excuses as to non payment.

Mr Simuchenje alleged that due to Pastor Chanda’s refusal to pay, he had been inconvenienced.

And now Mr Simuchenje is claiming payment of K85, 000 and an order for the attachment of motor vehicle.

He also wants interest, costs and any other relief that the court may deem fit.
