Ndola High Court declares Lusambo duly elected

Ndola High Court has upheld the election of Kabushi Member of Parliament and Copperbelt minister Bowman Lusambo. Delivering ruling in a case in which losing UPND candidate Enerst Lufunda petitioned the election of Mr Lusambo, Judge Yvonne Chembe stated that out of the 13 allegations of electoral malpractices alleged none had been proved. Ms Justice Chembe read her ruling to 10 people in court including the petitioner who sat in the gallery to listen to the judgment. Mr Lusambo was absent and his lawyer, a Mr. Muuya, sat in for him. The court indicated that Mr.
Lufunda as petitioner did not prove his case to the required standard. Judge Chembe said the need for clarity of evidence could not be over-emphasized in an election petition which was held in the highest esteem. “In the forgoing view I find the petitioner not having proved his grounds that there were electoral malpractices in the election held in Kabushi constituency. ‘‘I hereby declare the first respondent in the matter as having been dully elected as Member of Parliament for the said constituency and dismiss the case with costs but leave of appeal
granted,” she said.
