Judge Warns State

High Court Judge Fulgence Chisanga has warned government to stop commenting on the tribunal which is before her court as doing so amounted to contempt of court.

This was after one of the lawyers representing suspended Judges Nigel Mutuna, and Charles Kajimanga Abyudi Shonga asked the court for Guidance on the matter.

This follows an outburst from Minister of Justice Sebastian Zulu who suggesting that the judiciary was panicking and later warned of judicial dictatorship after justice Chisanga granted the suspended judges a judicial review.

“Before the respondent proceeds, there is an issue we wish to raise by way of seeking the courts guidance.  Judge since this matter was commenced we have been concerned to observe and hear statements being made and I am partciularly to the Hon. Minister of Justice (Sebastian Zulu) who is reported to have given a press conference on this issue.  I am not for a moment suggestion that this court should curtail citizens; freedoms of speech but the sort of comments that have been made in our view do not auger well especially that He knew that the matter is before court and I am happy that Solicitor General (Musa Mwenye) is before court as I express our clients concern and seek the protection  of the court,” Shonga said.
