Breach of contract lands Catholic Sister in court

MONZE Catholic Diocese has been dragged to court for their failure to pay K65 000 for the construction of St Joseph’s Secondary School Hall.

This is contained in a statement of claim filed before the Lusaka High Court in which Given Hankombo and 10 others have accused Mayuki Civil Contractors of having failed to pay them for works done for the Catholic school.

“By virtue of a written contract dated 11th May, 2013 and entered between Chrispine Cheelo as proprietor of Mayuki Civil Contractors and Sister Lozario Sakayombo as sister in-charge of St. Joseph, (Mr Cheelo) and Prudence Chiyuka (proprietor of Mayuki Civil Contractor) were engaged by the school to build a school hall.

“The School was completed in 2015 and the school gave the money to Mr Cheelo and Ms Chiyuka, but they neglected to give the complainants their share of the money amounting to K65 151 and have since stopped operating their enterprise,” he said.

The bricklayers charged that in 2016, they informed Mr Cheelo and Sister Sakayombo of their intention to take legal action over their payment but was advised against it by the later who promised them another job to build a school dormitory from which project they would be paid for the two jobs.

“The bricklayers and Mr Cheelo worked on the school dormitory and built it up to slab level.

“The plaintiffs then requested their money from the Sister in-charge of the school who refused to pay, claiming that it was for Mr Cheelo to pay them,” they claimed.

They have since requested for the immediate payment of K65 151 for their labour for building the school hall, and any interest and relief deemed fit for their claim.
